QNV 2030: driving economic growth beyond 2022

The Qatar National Vision (QNV) aims at transforming Qatar into an advanced country by 2030, capable of sustaining its own development and providing for a high standard of living for all its people and the future generations to come. In July 2008, the Qatari government published a formal outline of QNV 2030. The Vision was followed by the National Development Strategy, which outlined development strategies to be employed by government ministries in order to ensure that they are working toward QNV 2030 in an efficient manner. The Vision provides a framework within which national strategies and implementation plans are developed and is based on four interrelated principles. These four pillars are human development, social development, economic development and environmental development.

Economic development is an essential part of QNV 2030. Achieving that objective hinges on Qatar’s ability to create a balance between an oil-based and a knowledge-based economy, helping diversify the country’s economy and guaranteeing a stable and sustainable business environment.

Establishing a business in Qatar

Entities interested in doing business in the State of Qatar may choose one of the following forms of registration, depending on their preferences or nature of business:

  • Limited liability company (LLC)
  • Temporary branch
  • Permanent branch
  • Trade Representation Office (TRO)

Depending on the industry of the registering entity, a business owner may choose one of the business platforms to register with them, that way becoming eligible for multiple benefits ranging from infrastructure use to tax incentives. The following platforms have been established in Qatar to provide support to investors:

  • Register in the Qatar Science & Technology Park (QSTP)
  • Register in the Qatar Free Zone Authority (QFZA)
  • Register in the Qatar Financial Centre (QFC)
  • Register in Industrial Zone, Logistics or Warehousing

Taxation in Qatar

Qatar operates a territorial taxing regime. This means that only revenues derived from Qatar sources and from activities performed within Qatar are taxable in Qatar. Qatar GTA governs tax policies and frameworks. Qatar has two independent taxation frameworks:

  • State-registered entities are subject to the State Income Tax Law.
  • Entities registered in the QFC are subject to the QFC Tax Regulations.

The standard tax rate on profits is 10% under both frameworks. However, there are important distinctions between the two frameworks, most notably that the QFC does not apply withholding tax or contract tax retention. Qatar has ratified the GCC value-added-tax (VAT) Framework Agreement and is working on VAT implementation initiatives with the aim of introducing VAT in the State of Qatar. Qatar introduced excise taxes in January 2019 on an initial range of products that are deemed harmful to the health of its residents. A 50% rate applies to aerated soft drinks. A 100% rate applies to energy drinks, tobacco and alcohol.

10 things you need to know about doing business in Qatar

2022 will see many businesses enter Qatar for the first time, and companies with existing operations in Qatar will look to capitalise on an influx of foreign investment and tourism presented by the Qatar World Cup. While this is an exciting opportunity, Qatar has legal provisions which may be unfamiliar to foreign businesses. In this article, we set out 10 things to consider when doing business in Qatar.

1. Withholding Tax

Withholding tax is levied on any taxpayer who is not resident in Qatar and registered in the Qatar Commercial Register. It is charged at the rate of 5% in respect of any activity undertaken, in whole or in part, in Qatar which does not relate to a permanent establishment in the state.

Residents of Qatar are responsible for withholding tax on amounts paid to non-residents. Qatari companies contracting with foreign businesses will regularly seek the right to withhold applicable withholding taxes from any amounts payable.

Well drafted payment terms will leave no doubt as to the calculation, timing and method of payment, and will incorporate valuable safeguards for creditors. Back-to-back (or pay when paid) payment terms are common in Qatar contracts and present a greater credit risk than those where the timing of payments is pre-determined.

Provisions commonly used in Qatar to provide additional protection for creditors include:

  • The right to suspend work and / or terminate the agreement in the event of payment default;
  • Retention of ownership of goods until payment has been made;
  • Copyright licences being made conditional upon payment;
  • The right to make or, in the case of subcontractors, to receive direct payments; and
  • Clear and appropriate provisions in respect of dispute resolution.

One obstacle to prompt payment is the lack of any express provision under Qatar law for the award of interest on late payment. However, it is generally accepted that parties are free to agree on late payment penalties and, thus, contractual late payment penalties are likely to be upheld by the Courts pursuant to the general freedom of contract principle at Article 171 of Law No. 22 of 2004 (the Qatar Civil Code). The rate of interest the Court might award is, however, capped in practice at 5% and is limited to simple interest only.

3. Securities

Before, or at an early stage of negotiations, parties should consider whether requesting security of payment is appropriate. Common forms of security used in Qatar include:

  • Bank guarantees e.g. performance bonds;
  • Letters of Credit;
  • Parent company or personal guarantees;
  • Advance payment and escrow accounts;
  • Credit risk insurance; and
  • Post-dated cheques.

Bank guarantees and letters of credit are generally the most attractive forms of security for a supplier or creditor. The issuing bank will, for a fee, issue the security only if the customer or debtor is deemed credit worthy meaning the ability of a debtor to raise a bank guarantee or letter of credit itself provides an indication of credit worthiness.

Post-dated cheques however are readily available at no extra cost to the debtor. The potency of post-dated cheques in the Qatar market and the reason they are frequently accepted as security lies principally in Article 357 of Law No 11 of 2004 (the Penal Code) which makes it an offence in certain circumstances, to make payment using a cheque that is subsequently dishonoured.

4. Limitation of Liability

As a rule, parties contracting in Qatar can choose to limit liability in contract. This right is bolstered by Article 267 of the Qatar Civil Code which directly translates as:

“If the loss exceeds the value of the agreed compensation, the creditor may not demand more than this amount, unless he shows that the debtor has committed deception or gross mistake.”

However, this right to limit liability does not apply to liability arising from fraud or serious fault. There are also strict liability clauses in the law which cannot be contracted out of, i.e. they are mandatory.   For example, Qatar law imposes ‘decennial liability’; a form of liability under which construction contractors and engineers are jointly liable for failure or structural defects which effect the stability or safety of buildings/installations they have designed or constructed for ten years from the date of handover.

Under Qatar law, the primary remedy for breach of contract is compensatory damages which look to recompense an injured party for any loss sustained. By itself, a failure to give a contractual notice will rarely cause significant damage or deny a party any rights under a contract.

Parties are aware of this so commonly requirements to give notice are drafted as ‘conditions precedent’. A condition precedent is a contractual term which requires compliance as a precondition to any right or entitlement arising. In the context of notice provisions, this can involve making any entitlement to claim for time or money conditional upon notice being given.

Although common law and Qatari courts both acknowledge conditions precedent as valid, common law courts take a stricter approach to application, meaning that failure to issue a notice can be fatal to a claim. Qatari law provisions, by contrast, provide some scope to disapply notice conditions precedent – for example, when any losses suffered, if the notice condition precedent is applied, are deemed to be disproportionate to the loss suffered as a result of no notice being given.

6. Termination

Under Qatar law, it is arguable that a court order is required to terminate a contract unless the parties agree otherwise. This view is based on Article 184 of Law No 22 of 2004 (the Qatar Civil Code) which states:

“Agreement may be made to consider the contract annulled automatically without the need for a judicial ruling when there is a failure to perform the obligations arising from it.”

The provision is ambiguous (partly due to the use of the term ‘annulment’ in the translation above as opposed to termination) and court decisions supporting both contentions that an order is and isn’t required, can be found. Absent an express provision, the Courts of Qatar may still require an order before termination of a contract and it is prudent for advice to be sought before actioning the same. Parties to a contract can agree that a court order is not required to terminate a contract and doing so removes some uncertainty.

7. Force Majeure

Force majeure clauses are intended to protect parties from liability (and ideally include sufficient remedies) when an extraordinary event occurs outside the parties’ control. The scope of such clauses depends on their drafting, but they can generally be expected to relate to acts of God, forces of nature, or acts of governments and regulatory authorities, that prevent a party from fulfilling their contractual obligations.

The Qatar Civil Code generally supports the freedom of parties to agree their own contractual terms and Article 258 allows parties to agree that a contractor will be liable for the consequences of a force majeure or unexpected event. Article 171(2) further deals with exceptional, unforeseeable events which render performance of a contract burdensome (as opposed to impossible), and allows a Qatari court to balance the interests of the parties and restore the obligations to a reasonable level. This will likely be done on a case-by-case basis taking into account the circumstances of the event and the nature of the express term seeking to re-allocate its risk. Article 171(2) is a mandatory provision of the Qatar Civil Code and cannot be contracted out of by the parties. Performance becoming ‘impossible’ may be quite a rare occurrence; for example, price increases would likely not meet this requirement. Therefore, a court’s discretion may have wide application and the threshold will likely be high.  

8. Governing Law and Jurisdiction

Parties to contracts falling within the jurisdiction of the Qatar state courts may choose to have any disputes governed by the laws of a foreign jurisdiction. However, any party seeking to have foreign laws applied must provide certified translations of the relevant laws. This may be particularly challenging in the case of common law jurisdictions where a single, authoritative body of law is not readily available for translation.

The Qatar state courts’ approach with regards to jurisdiction is robust and they generally disregard, on public policy grounds, any agreement by the parties to submit their contracts to the jurisdiction of foreign courts. Should a Qatari court find itself competent to hear a dispute it will likely refuse to allow any referral to a foreign court. Agreements to arbitrate disputes are, however, generally recognised.

9. Dispute resolution

Foreign businesses may be familiar with alternative forms of dispute resolution which remain similar regardless of the jurisdiction (e.g. arbitration). Businesses with little or no experience with the Qatar state courts should be aware of the following points:

  • Qatar is a civil law jurisdiction with no doctrine of binding precedent with regards to court decisions (many of which are not published);
  • Qatar’s laws are based on Shariah principles and can, on issues such as compound interest, differ greatly to jurisdictions outside the Gulf;
  • Arabic is the language of the Courts and any document relied upon in court proceedings must be translated by a court certified translation company (of which there are only three);
  • Courts generally require original documents and less evidential weight is given to copies;
  • The length of time that proceedings take can vary significantly. Courts close for Ramadan and Eid and work at a reduced capacity during the summer months; and
  • No significant costs awards are granted to successful parties in the Courts of Qatar.

10. Good faith

Article 172 of the Qatar Civil Code states:

“1. The contract must be performed in accordance with its contents and in good faith.

2. The obligations placed on a contracting party are not limited to the contract’s contents, but also include its requirements according to the law, custom and justice in accordance with the nature of the obligation.”

In practice, this means the parties’ performance of all contracts will be measured against the standards of good faith as well as express contractual obligations. What constitutes ‘acting in good faith’ is highly fact specific but generally requires parties to be honest, fair and reasonable and avoid deceiving one another. Although such duties are common across the GCC region, many jurisdictions, such as England and Wales for example, do not require that parties act in good faith except in limited circumstances (often where there is a significant imbalance in their negotiating power).

Notably, the duty to act in good faith only relates to contractual performance meaning parties are not required to advertise or negotiate in good faith.

Qatar Airways has boasted some of the world's best business-class seats and service for the last decade. However, the airline raised the bar with the unveiling of its revolutionary Qsuite in March 2017. These were the first suite-style business-class seats, complete with closing doors and layouts that could be configured into four-person family or work areas and even double beds .

What was even more astonishing was the speed with which the airline rolled out the suites aboard its fleet. The first flight with them went into service in June 2017 , just three months after the unveiling.

Since then, Qatar Airways has put the Qsuite into service on many of its flagship routes, such as those between its hub at Hamad International Airport (DOH) in Doha, Qatar, and New York's John F. Kennedy International Airport (JFK), Heathrow Airport (LHR) in London and Paris-Charles de Gaulle Airport (CDG), among other destinations. Here's why you'll want to experience the Qsuite and how you can book it using miles.

Qatar Qsuite appears on versions of four different aircraft types: select Boeing 777-200LRs , 777-300ERs , Airbus A350-900s and all of Qatar Airways' A350-1000s . What might be confusing for flyers, though, is that Qatar Airways also flies 777s and A350-900s with older seat types . Luckily, we have a guide that explains how to tell if your flight has the new suites on them, and we'll get into the specific routes and flight numbers they're currently on below.

Both the 777-200LR (operating on some flights to O'Hare International Airport (ORD), Dallas Fort Worth International Airport (DFW), Dulles International Airport (IAD) and all flights to Seattle-Tacoma International Airport (SEA) and 777-300ER (operating on some flights to Chicago and Washington) have 42 Qsuites spread across two cabins. The forward cabin has six rows for a total of 24 seats, and the back cabin has five rows with a total of 18 seats.

The odd-numbered rows have rear-facing seats , while even-numbered rows have forward-facing ones. The rear-facing seats on the sides are closer to the window for more privacy, while those facing forward are closer to the aisle. In addition, those in the center sections are closer together when they're rear-facing and farther apart in the front-facing rows.

  • Doha to Europe: 61,000 miles one-way, 122,000 miles round trip.
  • Doha to New York: 90,000 miles one-way, 180,000 miles round trip.
  • Doha to Hong Kong: 61,000 miles one-way, 122,000 miles round trip.

One major downside to booking with Asia Miles is high taxes and fees. On a one-way flight from New York to Doha, you will pay $509 in addition to the miles you spend.

Transfer partners: American Express Membership Rewards, Bilt Rewards, Brex Cash, Capital One, Citi ThankYou Rewards and Marriott Bonvoy.

Taking into consideration taxes and fees -- as well as transfer partners -- your best bets are likely to be American Airlines AAdvantage miles or Avios. Your taxes and fees vary by route, but expect them to be under $100 round trip to the U.S. using AAdvantage miles and $150 to $250 with Avios, depending on the route.

Searching for and booking awards

We have several posts on this topic, including How to Search and Book Qatar Airways' Qsuite With Miles . However, as a refresher, the best way to search for Oneworld award availability is through the British Airways or Qantas websites.

If you're booking with American AAdvantage, you can also search on American's website. However, it's worth double-checking your results with the British Airways or Qantas website, as American's website sometimes fails to show all available award space.

If you find a flight on British Airways' website that isn't bookable on American's website, call American's AAdvantage desk to book it. If you plan to use Asia Miles, you can search availability through Asia Miles' own award search engine instead.

Keep a few things in mind before going on a mad dash searching for awards on all these routes. From my own personal experience, Qatar Airways awards tend to show up either far in advance or close in, but generally not in the few months out when most of us like to plan our trips.

The airline also tends to release more award space on newly-announced routes or when it swaps out aircraft on a route, so keep up on the news here on TPG to help you snag a seat on the route that you want.

Finally, be persistent. If you have dates and redemptions in mind, just search every few days and see what might come up. You might be surprised to find award seats released on some of the flights you're looking for.

So as not to end on a down note, though award space can be scarce, it is still available — even on premier routes like between Doha and New York and Doha and London. Here are a few sample awards I found to whet your appetite.

Critical information you may need regarding the country’s talent landscape

The country provides several facilities for recruitment in both high skilled and low-skilled jobs. These include various globally recognised job sites, services, and agencies, allowing employers to recruit talent at the national, regional, and international levels.

  • Employers must enroll their non-Qatari employees and their family members in the mandatory health insurance scheme through contracts concluded with insurance companies registered with the MOPH.
  • Qatar’s Law No.17 of 2020 introduced the non-discriminatory minimum wage applying to all workers, with a basic monthly wage of QAR 1,000 ($275 USD), and an allowance of at least QAR 300 and QAR 500 for food and housing respectively.
  • On average, the maximum working hours are 48 per week. During the month of Ramadan, it is reduced to a maximum of 36 hours per week or 6 hours per day. Workers are entitled to at least one day of rest per week.

The average monthly wage for the total number of workers amounted to nearly QAR 12,000.

The Ministry of Interior (MoI) set up visa centres to provide seamless and efficient service for residency procedures on its behalf in eight countries - India, Sri Lanka, Pakistan, Bangladesh, the Philippines and Nepal. Individuals must complete biometric enrolment, medical examinations, and sign work contracts in their home countries through the Qatar Visa Center (QVCs) before coming to Qatar.

Work permits are issued for a minimum of one year and a maximum of five years approved by the Ministry of Labor (MoL). The MoL offers an e-service for the issuance and renewal of work permits for workers.

There are over 32 higher education institutions in Qatar, with world-renowned universities and local training centres for upskilling talent.

Taxation in Qatar

Key for businesses and individuals seeking to understand the tax system in Qatar.

  • Under Law No. 24 of 2018 (the Tax Law), non-Qatari nationals and Qatari and/or GCC nationals who are not residents in Qatar are subject to corporate income tax at a flat rate of 10%.
  • A different tax rate applies to entities undertaking oil and gas / petrochemical operations, or where the activities are carried out under an Agreement with the Government. Such entities are generally taxed at a rate of 35% or higher.
  • A legal entity incorporated in Qatar, which is wholly owned by Qatari and/or GCC nationals that are tax resident in Qatar, is exempt from corporate income tax.

All taxpayers operating businesses in Qatar must obtain tax cards from the General Tax Authority (GTA).

Applications should be submitted within 30 days from commencing activities or registering with the Ministry of Commerce and Industry Commercial Register.

A body corporate is considered resident if it is formed and registered under Qatari law or if it conducts business through a head office or place of effective management in Qatar.

There are no taxes imposed on employed individuals’ salaries, wages and allowances in Qatar.

Currently, Qatar imposes no VAT or sales tax on operations in Qatar.

Qatar imposes excise tax on the following goods at their respective rates:

  • Tobacco and its products: 100%
  • Energy drinks: 100%
  • Carbonated drinks: 50%
  • Special-purpose goods (consumed under specific conditions and authorisations): 100%

Information on business laws and regulations

The General Authority of Customs (GAC) is the competent government authority responsible for monitoring and implementing all import and export regulations, working closely with other public and private agencies to ensure compliance with Qatar’s customs legislation.

In alignment with the GCC Customs Union, Qatar imposes a 5% ad valorem tariff on the value of cost, insurance and freight (CIF) invoice of general cargo goods, excluding those exempted by law provisions. The tariff may also include a fixed amount levied on each unit of the goods. The limited tariff exceptions are:

  • Records and music instruments: 15%
  • Urea and ammonia: 30%
  • Alcoholic beverages: 100%
  • Cigarettes and tobacco products: 100% or QAR 1,000 per 10,000 cigarettes, whichever is higher

The Qatari Labour Law enables employees to terminate their employment during their probationary period by providing a one-month notice to their employer.

The one-month notice period applies to employees who are in their first two years of service, whereas the two-month notice period applies to employees who have served longer.

TThe Commercial Companies Law provides for the following types of legal entities that may be formed and registered in the State of Qatar:

  • Joint Liability Company

  • Public Shareholding Company
  • Private Shareholding Company
  • Partnership Limited by Shares
  • Limited Liability Company
  • Holding Company

Foreign Investment Law (Law No. 1 of 2019) allows the establishment of 100% foreign-owned companies, with various incentives and benefits for non-Qatari investors as outlined by the law.

The 100% foreign ownership law does not apply to the banking and insurance sectors, companies engaged in the exploitation of natural resources, commercial agencies, and any other sectors decided by the Council of Ministers.

Ministry of Commerce and Industry (MOCI) offers a range of investment incentives, including land allocation for foreign investment projects by way of use or renewable rent. The foreign investor has the right to import what is necessary for the establishment, operation or expansion of their investment project, and the investor may be exempt from income tax and customs duties for machinery and equipment.

Qatar provides world-class healthcare through 27 regional Primary Healthcare Care Corporation Centers (PHCC), 12 public hospitals run by Hamad Medical Corporation (HMC), and over 20 private hospitals and clinics.

To apply for a Qatari Driving License, you must be a resident in Qatar, at least 18 years of age.

To apply for a Qatari Driving License, simply present the required documents to the traffic departments located in driving schools.

Documents include:

  • Qatari ID card and passport
  • A copy of the ID card of the sponsor (if the sponsor is a person)
  • A letter from the sponsor to approve the request for a new license
  • 3 recent colour photographs (passport size)

The license fee is QAR 250 for non-Qataris (valid for 5 years), and QAR 300 for heavy vehicles (valid for five years for non-Qatari). Additional fees apply for driving and vision tests.

Qatar is home to an innovative and advanced banking ecosystem – offering digital and mobile banking for users to seamlessly transfer and transact online. There are around 18 banks operating in Qatar through 202 local branches and about 20 exchange companies.

To open a bank account, the following are typically required:
